Effect of Extension of Limitation Period on MVAs

The COVID-19 pandemic shook up a lot of things in the world, including the limitation period to commence a lawsuit. A limitation period is the time limit that one person can commence a claim against another. In most situations, the time limit is two years from when the cause of action arose. This includes the time limit to commence a claim for your motor vehicle accident.

However, because of the pandemic, the Attorney General suspended limitation periods temporarily between March 26, 2020 and March 25, 2021. Therefore, depending on the date of your motor vehicle accident, you may have up to one whole year added to your limitation period.
